Terms of Service

1. Acceptance of Terms

By accessing or using Lumaforge ("the Service"), operated by Apurve Vidha ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including visitors, registered users, and subscribers.

2. Description of Service

Lumaforge is an AI-powered filmmaking studio platform that enables users to generate video content using third-party AI models (including but not limited to fal.ai, ElevenLabs, Anthropic, and PiAPI). We act as an intermediary and charge a service fee on top of underlying API costs. We do not guarantee the availability, quality, or output of any third-party AI model.

3. Account Registration & Authentication

You must create an account to use most features of the Service. Account authentication is handled by Clerk. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old to create an account. You agree to provide accurate, current, and complete information during registration.

4. Wallet, Credits & Payments

The Service uses a pre-paid wallet system. You may top up your wallet balance using Razorpay. All wallet balances are stored in USD cents. Payments processed in INR are converted using prevailing exchange rates.

• Wallet credits are non-refundable once used for AI generation.
• Unused wallet credits may be refunded within 14 days of purchase — see our full Refund & Cancellation Policy.
• Failed generations are automatically refunded to your wallet with no action required.
• We apply a 15% service markup over raw API costs.
• Subscription plans are billed monthly via Razorpay. You may cancel at any time; access continues until the end of the current billing period.
• All prices include applicable GST where required by Indian law.
• We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to use the Service to generate, upload, or distribute content that:

• Is illegal, defamatory, harassing, threatening, or fraudulent
• Infringes any third-party intellectual property, privacy, or publicity rights
• Contains sexually explicit material involving minors
• Depicts or incites violence, terrorism, or hate speech
• Constitutes misinformation, deepfakes designed to deceive, or non-consensual intimate imagery
• Violates the terms of any third-party AI provider we use

We reserve the right to suspend or terminate accounts that violate these policies without notice or refund.

6. Intellectual Property & Content Ownership

You retain ownership of the content you upload (reference images, audio, scripts). You grant us a limited, non-exclusive license to process your content solely to provide the Service.

AI-generated outputs produced through the Service are provided "as-is." Ownership of AI-generated content may be subject to the terms of the underlying model providers and applicable law. You are responsible for ensuring you have the right to use any reference material you upload.

The Lumaforge platform, brand, and underlying software are our exclusive property.

7. Watermark (Free Tier)

Videos exported on the Free tier will include a "Lumaforge" watermark burned into the video. Upgrading to a paid plan removes the watermark from future exports. Watermarks cannot be removed retroactively from previously exported files.

8. Service Availability & Limitations

We provide the Service on a best-effort basis. We do not guarantee uninterrupted or error-free operation. AI generation results depend on third-party providers and may vary in quality. We are not liable for any generation failures, API outages, or unexpected AI outputs. We may modify, suspend, or discontinue any feature of the Service at any time.

9. Data & Privacy

Our collection and use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED OUTPUTS WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

12. Indemnification

You agree to indemnify and hold harmless Apurve Vidha and its affiliates from any claims, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Bihar, India.

14. Changes to Terms

We may update these Terms from time to time. We will notify registered users by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

15. Grievance Officer

In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Consumer Protection Act, 2019, we have designated a Grievance Officer to handle complaints and concerns:

Users may also approach the appropriate Consumer Forum under the Consumer Protection Act, 2019 if their grievance is not resolved satisfactorily.
